UrbanSolutions Planning & Land Development Consultants Inc. is the authorized planning consultant acting on behalf of T. Valeri Construction Limited (Owner) to prepare and submit applications for an Official Plan Amendment and Zoning By-law Amendment for the lands municipally known as 73-89 Stone Church Road West & 1029 West 5th Street, in the City of Hamilton. The proposed infill development entails a ten (10) storey multiple dwelling with 237 units and 241 parking spaces. In addition, the proposal consists of 70 surface parking spaces and 171 underground parking spaces for a total of 241 spaces. To facilitate this proposal, the planning applications were submitted to the City of Hamilton on April 23, 2019.

The purpose of this website is to provide interested parties with access to the application details and supporting studies, and to provide an opportunity to participate in the planning process. Updates will be made to the site as they become available.

RESOURCES

Prior to submitting applications to the City of Hamilton, Urban Solutions participated in the City’s Formal Consultation process, where a version of the proposal was presented to City Staff for their review and comment. Through this process, it was determined the following reports and technical studies are required to facilitate a ‘complete’ application as defined by the Planning Act:

  • Survey Plan;
  • Concept Plan;
  • Planning Justification Report including Parks Issues Assessment and draft Official Plan Amendment and Zoning By-law;
  • Urban Design Report;
  • Sun/Shadow Study;
  • Archaeological Assessment;
  • Tree Protection Plan;
  • Functional Servicing Report;
  • Geotechnical Investigation;
  • Environmental Noise Impact Study;
  • Transportation Impact Study (TIS) including Transportation Demand Management (TDM) Options Report;
  • Public Consultation Strategy;
  • Right of Way Impact Assessment; and,
  • Official Plan Amendment and Zoning By-law Amendment Application.

These reports have been completed and submitted to the City of Hamilton in support of the proposal and copies of the reports are available for you to review.

PROJECT UPDATES

May 22, 2018 – Formal Consultation Application submitted.

July 18, 2018 – Development Review Team meeting held at the City of Hamilton.

April 23, 2019 – Zoning By-law Amendment and Official Plan Amendment applications submitted.

May 23, 2019 – Zoning By-law Amendment and Official Plan Amendment applications deemed complete.

September 19, 2019 – Neighbourhood Information Meeting held at Barton Stone – Mount Hope United Church.

February 07, 2020  – Resubmission made in support of the Zoning By-law Amendment and Official Plan Amendment applications.

June 11, 2020  – Resubmission made in support of the Zoning By-law Amendment and Official Plan Amendment applications.

July 30, 2020 – Zoning By-law and Official Plan Amendment applications appealed to Ontario Land Tribunal (OLT) (formerly Local Planning Appeal Tribunal – LPAT) by applicant for municipalities failure to make a decision within the prescribed time period as outlined in the Planning Act.

October 18-22, 2021 – Ontario Land Tribunal (OLT) hearing.

January 20, 2022 – Ontario Land Tribunal (OLT) Decision issued.
